Terms and Conditions of Sale
1. Orders & Products
All orders are subject to email confirmation by us. Please note that the products displayed on the US Site may be out-of-stock or discontinued, and availability is not guaranteed. Please note that while we have tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate.
All prices are in US Dollars. Prices may change without notice from time to time. The total amount due is inclusive of sales tax applied in accordance with applicable state and local regulations based on your shipping address. The applicable sales tax amount is indicated on the payment page of the cart.
The amount of sales tax charged on your order will depend upon various factors, including type of item purchased, sales price and destination of the shipment. Sales tax regulations may change between the time you place an order and the time of credit card charge authorization and this may affect the calculation of sales taxes. The amount appearing on your payment page of the cart may differ from the sales taxes ultimately charged as indicated in the invoice you will receive with the shipping confirmation email.
All prices are inclusive of customs and import duties.
3. Shipping Costs
You are responsible for the shipping costs associated with the delivery of the products you purchase on the US Site as specified on your order confirmation.
4. Shipments and Delivery
You bear all risks of loss and damage to the products from the time the same have cleared our fulfillment house. Delivery is deemed complete and title to the products passes to you upon acceptance of shipment by a common carrier.
4.1. Pick up in Store
You can choose to receive the products you have purchased at your chosen address or at a Stone Island Store in your country of purchase, selected from those listed on www.stoneisland.com. If you have chosen delivery to a Stone Island Store, we will inform you by email when the product are available in the point of sale. In this case, you must collect the purchased products from the chosen point of sale no later than 20 days after the aforementioned email is sent. Should you fail to collect the products within the aforementioned period of 20 days, the purchase shall be understood, to all intents and purposes, to be automatically terminated. Consequently, it will no longer be possible to collect the products, which will be returned to the Vendor by the personnel of the chosen point of sale. As a result of the termination of the contract of purchase of the products, you will be reimbursed the sums paid.
When you go to the point of sale to collect the order, you must show the sales assistant a copy of the delivery confirmation email, as well as a personal identification document. We would like to remind you that you cannot pay for the items at the point of sale, which means that you cannot select the cash-on-delivery option if you choose delivery to a point of sale.
4.2. Click from Store
You can also purchase one or more products from www.stoneisland.com by going to one of the Stone Island stores listed on www.stoneisland.com. The shop staff will be able to place the order on your behalf using an appropriate electronic device.
5. Returns and Refunds
Please refer to our Return and Refund Policy, which forms an integral part of these General Terms and Conditions of Sale. In certain specific cases, duly specified in the Return Form, you are allowed to replace purchased products with other products, instead of being refunded the relative price.
5.1. Return in Store
If you decide to return products directly to one of the Stone Island stores listed on www.stoneisland.com, you do not need to fill out the online return form. Instead, give the sales assistant the products, the original packaging, the pre-printed label and the delivery note within twenty (20) days of receiving the products. The sales assistant will check that the products still have their tags attached and do not have any defects that make them unusable. If defects are found during a preliminary check, the sales assistant will not be able to accept the products and will ask you to contact YOOX NET-A-PORTER GROUP Customer Service directly. If no defects are found during this check, the sales assistant will fill out the return form, take the products, place them in their original packaging and affix the pre-printed label to it so that the items can be returned to the Seller. It is understood that the sales assistant only conducts a preliminary check on the products and that dropping off products in the store does not imply that the return has been accepted by the Seller. Once they have received the products at their warehouse, the Seller will check that the products comply with the terms and conditions indicated in our Return and Refund Policy. They will then inform you by email if the return is accepted.
